Terms of Service
By commissioning me (Susanna Fullerton), you agree to the below terms of service. You understand that violating these terms may result in refusal of future commissions.
Content:
I do not draw explicit content, or create commissioned art for books which contain explicit/open-door/“spicy” content. If your book contains such content, please respect my personal convictions and look elsewhere for an illustrator.
I reserve the right to refuse a commission for any reason.
Rights:
I retain the copyright to my work, and you may not claim my artwork as your own work. I reserve the right to post any commissioned artwork on social media or use it for portfolio and promotional purposes unless otherwise requested by the client.
All commissions are personal-use only unless otherwise requested. Personal use commissions may be posted on social media, used as profile icons, printed for friends and family, and otherwise reproduced freely for not-for-profit uses.
Commissioned artwork used in any for-profit manner, including as pre-order incentives, kickstarter rewards, merch, or in-book illustrations, falls under commercial use and will require an additional fee.
Commercial-use commissions will also require a licensing contract to be signed prior to payment.
Payment and Refunds:
All prices are listed in USD.
Payment is via Zelle bank transfer or PayPal invoice only. (You do not need your own PayPal account, just an email I can send the invoice to!)
Payment will be completed in two installments: A 50% non-refundable upfront deposit is required before starting on the sketch. The remaining 50%, as well as any additional fees incurred during the creation process, will be paid upon completion of the final image. Custom payment plans can be discussed for larger commissions such as book covers (an upfront deposit will still be required).
If the client must cancel the commission, refunds will depend on current progress and artist’s discretion. The 50% upfront deposit is non-refundable unless at artist’s discretion provided the commission was cancelled before moving past the sketch phase. If the client cancels the commission after I (the artist) have begun coloring, I cannot offer a full refund and the client may be asked to pay a percentage of the remaining fee. If the commission is canceled in the final stages, when the artwork is almost completed, no refund will be available and the client must pay the remaining fee.
If I have to cancel the commission on my end due to a scheduling conflict, emergency, or other circumstances on my end that prevent me from completing the commission, a full refund will be issued, including the deposit.
If I have to cancel the commission due to the client violating the terms of service, however, this will be considered as the client cancelling the commission, and the applicable refund policies will apply.
Please note that if a commercial-use commission is canceled, the client revokes all commercial rights to the commissioned artwork, including any progress images sent by the artist.
Process, Revisions, and Turnaround:
After details are finalized and the upfront deposit is paid, I will send a sketch for approval. I will also send updates at major stages (lineart, flat color, etc.) for changes and approval, with additional progress updates available upon request.
Revisions are generally free and welcome throughout the process. However, major revisions later into the process may incur an additional fee. Any mistakes on my end, such as missed details from the character description, can always be fixed for free!
Completed artwork will be delivered as a digital PNG file or other applicable file type via Google Drive. Additional file types, such as JPEG, are available upon request.
Turnaround time is typically about 3-4 weeks for character illustrations, chibis, or other standard commissions. Book covers and other more complicated projects can take at least 2 months.
If your project has a specific deadline, please let me know ahead of time, before we begin on the commission. Rush fees may apply.
Generative AI Content Usage:
Commissioned artwork may not be uploaded, submitted, or otherwise used to train AI image generators.
Commissioned artwork may not be used as a base or reference for AI-generated content, nor should it be used to instruct an AI tool to create derivative works based on my artwork.
Any unauthorized AI-related use of the commissioned artwork will be considered a violation of these terms and may result in legal action.
